These Terms of Service (“Terms”) govern your use of the websites, embeddable calculators, and related services (the “Services”) provided by Instimate, operated by MODRN IO INC(“Instimate,” “we,” “us”). By using the Services, you agree to these Terms.
The Services
Instimate provides instant cost-estimate tools that home-service businesses (“Contractors”) embed on their websites. If you are a visitor, you can use a Contractor's calculator to receive an estimate and, optionally, request an on-site estimate. If you are a Contractor, additional agreements govern your account and billing.
Estimates are indicative, not a binding quote
Any price range shown by the Services is an informational estimate only, generated from the details you provide and general market data. It is not an offer, a contract, or a guaranteed price. Actual pricing is determined by the Contractor, typically after an on-site assessment. Coupons or credits shown are offered by the Contractor and are subject to their stated terms (for example, one per project, no stacking without approval, and an expiration period).
Eligibility and acceptable use
You must be at least 18 years old to submit a request. You agree to provide accurate information, to use the Services only for lawful purposes, and not to interfere with, probe, scrape, or overload the Services or attempt to bypass security or verification controls.
Communications consent
By submitting your information you agree to be contacted about your project. If you provide a mobile number and request an on-site estimate, our Messaging Terms apply. See our Privacy Policy for how we handle your information.
Intellectual property
The Services, including their software, design, and content, are owned by Instimate or its licensors and are protected by law. Contractor brand names, logos, and content belong to the respective Contractor.
Disclaimers
The Services are provided “as is” without warranties of any kind, express or implied, including as to accuracy of estimates, merchantability, or fitness for a particular purpose. We do not warrant that the Services will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Instimate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on an estimate or from your dealings with any Contractor.
Governing law
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules.
Changes
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance.
